In data 7 novembre 2019 sono state pubblicate le Linee Guida dell’European Data Protection Supervisor (EDPS), emesse in soccorso alle istituzioni ed agli organi dell’Unione Europea ma valevoli in generale, a mezzo delle quali sono stati meglio precisati i concetti di Titolare, Responsabile e Contitolare del trattamento dei dati personali

In data 28 ottobre 2019, invece, il Garante Italiano ha escluso dal novero dei Responsabili del trattamento le Compagnie Assicurative sulla base di un principio che, per analogia, può essere applicato anche ad altre categorie di soggetti.

T.A.R. Lazio Roma, sez. I, 10/12/2019, n. 14129. Istanza di accesso agli atti e documento richiesto non ostensibile ex art. 54-bis D.Lgs. 165/2001.

La recente sentenza del T.A.R. Lazio si è pronunciata in senso favorevole sulla richiesta di annullamento della nota dell’ANAC dell’11 ottobre 2019 prot. 80390 con la quale il Dirigente dell’Area Vigilanza – Ufficio Vigilanza Lavori aveva comunicato che il documento richiesto dal ricorrente non era ostensibile poiché rientrante nell’ambito di tutela di cui all’art. 54 bis D.Lgs. 165/2001 e dell’art. 22 comma 3 del regolamento ANAC sui procedimenti relativi all’accesso civico e ai documenti detenuti dall’ANAC.
